Ad Hoc Committee on Creditors' Rights to Non-Exempt, Non-Probate
This Ad Hoc Committee was appointed to draft proposed legislation creating an orderly procedure for the payment of enforceable claims of creditors from a decedent's non-exempt, non-probate assets when the probate estate and revocable trust are insufficient to pay all enforceable claims. The proposed legislation is not intended to give a decedent's creditors any rights to assets which they do not have under current law and which they did not have during the decedent's life.
